Terms & Conditions Last Updated: March 2, 2026 Welcome to EleWinza ("Company," "we," "our," or "us"). By accessing or using our website, applications, and services including WhatsApp Business API, CRM tools, chatbot automation, marketing tools, and related services (collectively, the "Services"), you ("User," "Customer," "Client") agree to comply with and be bound by these Terms & Conditions. If you do not agree, please discontinue use of our Services immediately. 1. Eligibility You must be at least 18 years old to use our Services. You confirm that you have the authority to accept these Terms on behalf of yourself or your business. Use of Meta platforms (WhatsApp, Facebook, Instagram) must comply with their respective policies. 2. Services Provided EleWinza provides: WhatsApp, Facebook, and Instagram API integrations CRM & Customer Management solutions Chatbot and Automation Builder Marketing automation & campaign tools Business integrations (eCommerce, APIs, etc.) Analytics, reporting, and support services We reserve the right to modify, update, or discontinue any service at any time without prior notice. 3. Account Registration & Security You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials. All activities under your account are your responsibility. EleWinza is not liable for unauthorized access due to user negligence. 4. Acceptable Use Policy You agree not to: Use the Services for illegal, fraudulent, or abusive activities Send spam, unsolicited messages, or prohibited content Violate policies of WhatsApp, Meta, or other platforms Upload malware or attempt unauthorized access Misuse automation tools in violation of laws Violation may result in immediate suspension or termination without refund. 5. Pricing, Payments & Refunds All prices are in INR (₹) unless stated otherwise. Payments must be made in advance as per selected plan. Add-ons and additional services are billed separately. Services are non-refundable once activated unless required by law. Non-payment may result in service suspension or termination. 6. WhatsApp Verification & Green Tick We may assist in WhatsApp Business verification and Green Tick applications. Approval is solely at Meta’s discretion. We do not guarantee approval. Fees for such services are non-refundable once processed. 7. Data & Privacy Your data is handled as per our Privacy Policy. You are responsible for obtaining user consent before using their data. We may process data such as messages, CRM records, and automation logs to provide services. 8. Intellectual Property All software, branding, and content belong to EleWinza or its licensors. You are granted a limited, non-transferable license to use our Services. You may not copy, modify, or distribute our platform without permission. 9. Third-Party Integrations Our Services may integrate with third-party platforms (Meta, Shopify, WooCommerce, etc.). We are not responsible for their downtime, changes, or policies. Your usage of third-party platforms is subject to their terms. 10. Service Availability We strive for high uptime but do not guarantee uninterrupted service. Maintenance or third-party issues may cause temporary downtime. EleWinza is not liable for losses due to such interruptions. 11. Limitation of Liability To the extent permitted by law, EleWinza is not liable for indirect or consequential damages. Liability is limited to the amount paid by you in the last 12 months. We are not responsible for business losses due to downtime, Meta or WhatsApp approval delays or rejections, or misuse of services by users. 12. Indemnification You agree to indemnify EleWinza and its team from any claims, damages, or losses arising due to misuse of Services, violation of these Terms, or violation of applicable laws or platform policies. 13. Termination You may terminate your account at any time by contacting us. We may suspend or terminate your account for violations or non-payment. Data may be deleted after termination, subject to legal requirements. 14. Governing Law & Jurisdiction These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of Bengaluru, Karnataka courts. 15. Changes to Terms We may update these Terms at any time. Continued use of our Services after updates implies acceptance of the revised Terms. 16.
